Other Answers start -->Im not 100% sure, but this same thing happened to me. I was told by the store that I had to have uploaded them to the photo section of your providers website.. and then download them to your new phone from there... or send them as an email to a friends phone and have them send them back to your new one. If the phone is not activated anymore.... theres no way to get them untill its reactivated. Sorry.
