yes you can use it. dunno how to update it.
You can use it with the data plan on your GSM (note lone GSM) network. Bear in mind that only AT&T contained by the States has widespread 3G coverage, so others providers may drop to EDGE or GPRS data, which is much slower
Updating an unlocked iPhone may require you to simply use the Update Firmware function surrounded by iTunes, however this may break it, so its best to check on the iPhone dev team blog when I new firmware comes out before you update.
