i heard that they are letting people buy the contemporary iphone 2 without buying a contract or activation in the store because they be having technical problems? is this true? because if it is, i don't want to use it as a phone, simply as a cheaper ipod touch, with a camera =p =p

No. On the first day, the servers that activate the iPhone went down and activations were on hold for a while. The activations go "most of the way through" but couldn't complete, so they allowed people to pilfer the phone home so they could complete the activation once the servers came back online. Until after, the phone was "bricked."
The problem has since be resolved and to get the phone, you have to enjoy it activated in the store, sign a contract and gain the data package up to that time you can leave with it.
